Waiver and Release

IN CONSIDERATION of Mercedes-Benz Canada Inc. ( “MBC”) allowing the Driver(s) to use the motor vehicle described below (“Vehicle”), the parties hereby covenant and agree to the following:

1. The Driver(s) of the Vehicle shall be in possession of a current permit to operate the Vehicle. The Driver(s) shall have substantial driving experience and will operate the Vehicle in a conservative and cautious manner.

2. The Vehicle shall be provided to the Driver(s) in good and safe mechanical condition and shall be returned to MBC in the same condition.

3. Each Driver shall obey all federal, provincial and municipal laws, rules and regulations relating to the operation and use of the Vehicle and MBC shall not be responsible or liable for any fines or charges imposed against MBC for any infractions of such laws, rules and regulations.

4. If at fault, the Driver(s) shall assume responsibility for the first $5,000 of any physical damage sustained while the Vehicle is in his/her possession, howsoever caused.

5. The Driver(s) shall pay all costs of operating the Vehicle, including all fines and toll charges incurred while in possession of the Vehicle.

6. The Vehicle will only be used for product review and testing and not for private purpose.
